According to an announcement made by Novartis, CIBA Vision, the producer of the innovative AIR OPTIX™ NIGHT & DAY™ Aqua lens, has made a settlement agreement with Johnson & Johnson Vision Care, Inc. with respect to CIBA Vision’s “Nicolson” patents protecting its technology associated with silicone hydrogel contact lenses.
This agreement ends a dispute that took place in the US and a few countries in Europe.
Novartis stated that the settlement covers all the silicone hydrogel contact lenses produced by Johnson & Johnson Vision Care, including Acuvue Oasys, Acuvue Advance and 1-Day Acuvue TruEye. It makes it possible for Johnson & Johnson to keep manufacturing, marketing and selling its silicone hydrogel contact lenses globally in accordance with a licence agreement with CIBA Vision. This means that Johnson & Johnson may now sell its products in markets, which were previously under an injunction.
The terms and conditions of the agreement, including its financial aspects, have not been disclosed.
